Terms of Service

1. Eligibility: you must be 18 or older

The Service is strictly for adults. You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to create an account or use any part of the Service.

By using the Service you represent and warrant that you are an adult, that the information you provide is accurate, and that you are legally permitted to access mature content where you live.

• We may ask you to confirm that you are 18 or older before granting access.
• We may refuse, suspend, or terminate access if we have reason to believe a user is a minor or has misrepresented their age.
• If you are a parent or guardian and believe a minor has accessed the Service, contact us immediately at epoch.feedback@gmail.com.

2. What the Service is, and is not

The Service provides interactive conversations with artificial-intelligence ("AI") personas. Every persona, character, name, backstory, image, and message is fictional and computer-generated.

• The personas are NOT real people. They are not licensed professionals, counsellors, doctors, lawyers, or advisors.
• AI responses are generated automatically and may be inaccurate, offensive, or inappropriate. They do not represent our views.
• The Service is for entertainment and companionship only. It is not a substitute for professional medical, psychological, legal, financial, or any other advice.

Do not rely on the Service for any decision that requires professional judgement. If you are in crisis or distress, contact local emergency services or a recognised helpline immediately.

3. Mature themes

The Service contains mature, fictional romantic and dramatic content, including flirtation, romance, and suggestive or "forbidden" scenarios (such as rivals, affairs, or dark-romance tropes). This content is suggestive and emotionally charged but is not sexually explicit; intimate moments fade to black.

• Every character is written and intended to be a fictional adult. Any depiction, request, or roleplay involving minors is strictly prohibited and will result in immediate termination and may be reported to authorities.
• All roleplay is consensual fiction. Content depicting non-consent, real-world sexual violence, or illegal acts as endorsed or instructional is prohibited.
• Dark or taboo themes (e.g. villain, possessive, or forbidden-romance tropes) are fictional atmosphere only and do not endorse real-world conduct.

4. Acceptable use

You agree NOT to use the Service to create, request, upload, or solicit content that:

• Sexualises, depicts, or involves minors in any way, real or fictional;
• Depicts real, identifiable people without their consent, or impersonates any real person;
• Promotes, instructs, or facilitates illegal activity, terrorism, self-harm, or violence against real people;
• Is non-consensual sexual content involving real persons, or content intended to harass, defame, or threaten others;
• Violates any applicable law of India or your local jurisdiction.

You also agree not to scrape, reverse-engineer, resell, or attempt to extract our persona definitions, prompts, or models, and not to abuse, overload, or interfere with the Service. We may remove content and suspend accounts that violate these Terms.

5. Your account

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly of any unauthorised use. We are not liable for losses caused by your failure to safeguard your account.

6. Credits, subscriptions & payments

Paid plans, credit packs, and per-feature credit costs are described on our Pricing page. Payments are processed by our third-party payment provider (Razorpay); we do not store your full card details.

• Subscriptions renew automatically until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period.
• Credits and subscription fees are generally non-refundable except where a refund is required by applicable law or expressly stated by us. Credits have no cash value and may expire as described at purchase.
• We may change prices prospectively. Changes will not affect a billing period already paid for.

7. Your content and conversations

You retain ownership of the messages and inputs you provide ("User Content"). To operate the Service, you grant us a limited, worldwide, royalty-free licence to store, process, and transmit your User Content (including sending it to our AI model providers to generate responses) solely to provide and improve the Service.

You are solely responsible for your User Content and must have the right to share it. See our Privacy Policy for how your data is handled.

Images you generate with a persona may be shown anonymously in community galleries within the Service (for example, on a persona's page or the gallery), visible to other signed-in members, as examples of what users create. They are displayed without your name, username, email, or any account identifier, and never include your messages or conversation. By generating an image you grant us a worldwide, royalty-free licence to display it for this purpose. To have an image you created removed from these galleries, email epoch.feedback@gmail.com and we will remove it.

8. Intellectual property

The Service, including personas, names, artwork, software, and branding, is owned by Soul Patcher or its licensors and is protected by law. You may not copy, distribute, or create derivative works from it except as expressly permitted.

9. Disclaimers: provided "as is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI output will be accurate or suitable. You use the Service at your own risk.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY EMOTIONAL DISTRESS, LOSS OF DATA, OR LOSS OF PROFITS, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR YOUR RELIANCE ON ANY AI OUTPUT.

Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the three (3) months before the claim, or ₹1,000.

Some jurisdictions do not allow certain limitations; in that case the limitations apply to the fullest extent permitted.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your breach of these Terms or any law.

12. Suspension & termination

We may suspend or terminate your access at any time for any violation of these Terms or to protect the Service or other users. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (e.g. disclaimers, liability, indemnity) will survive.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after changes take effect constitutes acceptance.

14. Governing law & disputes

These Terms are governed by the laws of India. Subject to applicable law, the courts of competent jurisdiction in India will have exclusive jurisdiction over any dispute arising from these Terms or the Service.
